During a visit by Ukrainian judges and developers of judicial training programmes to the Supreme Court of Latvia, representatives of the Senate’s Department of Administrative Cases shared their experience in adjudicating cases involving personal data protection.
Anita Kovaļevska, Chair of the Department of Administrative Cases, noted that such cases are rarely focused exclusively on personal data protection; however, this issue constitutes an important aspect across various categories of cases. Jānis Geks, Legal Research Counsel of the Department, provided a comprehensive overview of the personal data protection cases examined by the Senate, as well as the Senate’s case-law in this field. Chair Anita Kovaļevska and Senator Ieva Višķere also answered questions from the participants. The discussion covered a range of topics, including the burden of proof in such cases, the disclosure of lawfully obtained data to third parties, publicly available information concerning judges, and other related matters.
The Council of Europe-funded training project for Ukrainian judges, “Support to Ukraine in the implementation of Council of Europe standards on the judiciary,” is being implemented in Latvia by the Data State Inspectorate. During their visit, the Ukrainian delegation was received by several judicial institutions.
