The Supreme Court (Senate) has prepared a summary of case-law in cases concerning the implementation of agricultural policy instruments, namely in cases in which the Rural Support Service has been called in on the defendant's side, as well as in cases related to aid payments and compensations for restriction of property rights.
The summary systematizes the findings of the Department of Administrative Cases of the Senate established in rulings that were made from 2010 to 2023.
The findings of the Senate are arranged according to legal acts. Namely, a legal norm is indicated, followed by findings of the Senate regarding the interpretation and application thereof. Moreover, relevant informative indications are added as references to cases in which the Senate has submitted preliminary questions to the Court of Justice of the European Union. Taking into account that the regulatory framework pertaining to discussed issues is fragmented, and that the framework refers to both the European Union legal framework and to the national legal framework of Latvia, a detailed table of contents has been created for the convenience of users. In addition, an index of court cases has been created, thus systematizing cases by types of support payments/compensation or legal issues.
In the concluding part of the compilation, there is a list of cited rulings and hyperlinks are added to those rulings published on the Internet. In addition, a separate appendix has been created containing court cases in which Latvian courts have addressed the Court of Justice of the European Union for a preliminary ruling on issues related to the granting of aid/compensation payments and costs thereof.
