The Division of Case-law and Research of the Supreme Court has summarized the case-law of the Department of Civil Cases regarding the consumer rights protection.
The findings of the Department of Civil Cases related to consumer protection issues that are significant in the cases examined before the court are summarized: application of procedural rules in disputes where one party is the consumer; the duty of the court to assess the terms of the contract concluded with the consumer; court powers when establishing an unjust contract terms; evaluation of contract terms; examples of unjust contract terms; examples of contract terms that are not recognized as unjust; uncontested contract terms and understandability of contract terms; the legal balance of the contracting parties; the application of provisions of consumer rights protection to various disputes; consumer’s obligations; responsibility of the consumer for the damage suffered.
The findings of the Department of Civil Cases are supplemented by the case-law of the Court of Justice of the European Union regarding relevant issues.
