The Supreme Court has prepared a summary of case-law in cases of disclosure of undisclosed information by a public official who has been warned about the non-disclosure of information or who is responsible for safeguarding information according to law.

The summary contains systematized findings of the Department of Criminal Cases of the Senate established in rulings that were made between 2013 and 2023.

It should be noted that the court rulings included in the case-law compilation were adopted in cases where a person was held criminally liable according to Section 329 of the Criminal Law in the wording of the law which was in force until April 30, 2023 and which provided for the responsibility of a public official for disclosing undisclosed information that is not a state secret. With the amendments to the Criminal Law, which entered into force on May 1, 2023, this Section of the Law was reworded and now provides for the responsibility of public officials for the disclosure of such undisclosed information that is not confidential, secret or top-secret information.

The summary is designed as an overview of the Senate's decisions in criminal cases pursuant to Section 329 of the Criminal Law. The summary provides a general overview of the most important findings of the Senate. The second part of the summary provides a general overview of the Senate's decisions, grouped chronologically, indicating the subject of the criminal offense, the factual circumstances of the case, the most important reference points regarding the progress of the case and the findings expressed in the Senate's decision.

In the concluding part of the compilation, a list of cited rulings is added, which, in addition to the Senate's decisions, includes other rulings adopted in a specific case. Hyperlinks have been added to those rulings that have been published on the Internet.

The summary was prepared by the Division of Case-law and Research in cooperation with the Department of Criminal Cases of the Senate.
