Continuing the tradition which started last year, on 20 February a discussion between Senators of the Senate's Department of Criminal Cases and Chairs of Collegiums of Criminal Cases of the Regional Courts took place, this time remotely. The aim of such meeting is to develop the exchange of opinions between the cassation and appellate instances, to promote uniform case-law, and to discuss topical legal issues in a timely and efficient manner.
The senators of the Senate’s Department of Criminal Cases and the chairs of the Collegiums of Criminal Cases Silva Reinholde from the Kurzeme Regional Court, Elfa Driba from the Vidzeme Regional Court, Ingūna Amoliņa from the Riga Regional Court, Judge Andris Zutis from the Latgale Regional Court and Judge Līga Baltmane-Zepa from the Zemgale Regional Court, discussed current legal issues.
The discussion was based on a number of issues such as the problems of application of Section 381(22) of the Criminal Law and Section 455(4) of the Criminal Procedure Law, as well as the understanding of Clause 43 of the Cabinet of Ministers’ Regulation of 17 December 2024 No 901 "Regulations on Competent Institutions and Handling of Property Belonging to the State".
In order to proceed with the successful exchange of views between the cassation and appellate instances, this year the representatives of the Senate’s Department of Criminal Cases will also meet individually with the judges of the Collegiums of Criminal Cases of each Regional Court in person.
