If the litigation reaches the point of appealing a regional court ruling in the Senate, it is important to consider whether to do so, and if it is decided to file a cassation complaint, it is crucial to prepare a high-quality cassation complaint. To assist parties to proceedings in this process, the Supreme Court has prepared three information leaflets on preparing and submitting cassation complaints in civil cases, criminal cases, and administrative cases.
The leaflets provide a concise explanation of what cassation proceedings are, how they differ from proceedings before lower courts, and in which cases the Senate refuses to initiate cassation proceedings.
Emphasizing that the content of a cassation complaint differs significantly from that of an appeal, the booklets explain this difference and provides guidance on what to consider when preparing a cassation complaint.
Regarding each type of court proceedings covered in the leaflets (civil, criminal and administrative) there is information included on security deposit, parties to proceedings, the application of Senate’s case-law, and other matters.
To ascertain that a cassation complaint is prepared in accordance with all legal requirements and Senate’s recommendations, the leaflets contain checklist questions that are worth answering before filing a cassation complaint.
The information leaflets have been prepared in accordance with the Guidelines on the preparation of a cassation complaint approved by the Senate in 2023 and published on the Supreme Court's website. The leaflets stress that these Guidelines should be used when preparing a cassation complaint.
The leaflets are available at the Supreme Court and will also be sent to regional courts (appellate courts) and district courts (first instance courts), the Latvian Council of Sworn Advocates, the Prosecutor General's Office, the Legal Aid Administration, the Ombudsman's Office, the Free Trade Union Confederation of Latvia, the Latvian Association of Local and Regional Governments and law faculties of universities.
