The aim of the compilation of case-law is to summarize the findings of the Department of Civil Cases of the Supreme Court (before 2014 – the Department of Civil Cases of the Senate) on the application of the provisions of the Labor Law, in order to promote a uniform understanding of the law and create uniform case-law. At the same time, the summary also includes findings related to labor law regarding the application of certain provisions of the Civil Law and Commercial Law.
The findings expressed by court rulings are associated to relevant legal provision (section, paragraph or clause).
The summary comprises the findings by rulings of the Department of Civil Cases from 1 July 2012 to 31 December 2017 (both the rulings published in the archive of case-law decisions on the website and in other rulings of the Department of Civil Cases).
A summary was prepared by the Assistant Judge of the Department, Mg.iur. Konstantins Vaivods, on the initiative of the Department of Civil Cases of the Supreme Court.
So far, there have been several studies, including case-law summaries, on issues relating to the application of the labour law. The following studies are available on the website of the Supreme Court www.at.gov.lv: summary of the case law of 2005 "On application of laws, when resolving disputes related with termination or amending of labour contract, in courts", summary of 2005 "Questions about application of standards of the Labour Law" and a summary of case law of 2010/2011"Case-law in cases about individual labour disputes". In its turn, in 2012 a study "Compilation of case-law arising from labour law" was published, which, inter alia, shows the findings of the Senate of the Supreme Court in labor law for the period from 1 January 2009 to 1 July 2012 (the study is available electronically: http://www.lbas.lv/upload/stuff/201301/tiesu_prakse.pdf).
