On issues reviewed in the session of the Board of Justice on the 22nd of February

The Judicial Conference is postponed to autumn Latvian Judicial Conference, which had to be convoked in April, is postponed to autumn. The Board of Justice has adopted such decision due labour-saving considerations, so that it wouldn’t be necessary to organise one more conference, when the Saeima would make amendments to the law “On Judicial Power”, in relation to which it will be necessary to convoke judicial conference.

Issues reviewed in session of the Board of Justice on the 27th of January

The Board of Justice supports rights for a judge to keep the office, when standing in the Saeima’s elections. The judge should leave the office, only if s/he would be elected in the Saeima. The Legal Affairs Committee of the Saeima asked for opinion of the Board of Justice on amendments initiated to the law on elections of the Saeima, so this issue was reviewed in session of the Board of Justice on the 27th of January.

The Board of Justice doesn’t support including judges in united system of state salaries

The Board of Justice doesn’t support draft laws of amendments to the Law on Remuneration of Officials and Employees of State and Municipal Authorities, the law “On Judicial Power”, the Law on Prosecutor’s Office and the Law on the Constitutional Court prepared by the Cabinet of Ministers. Those provide inclusion of remuneration of judges into united system of state salaries. The Board of Justice believes that possibilities to execute judgment of the Constitutional Court of June 22, 2010, within existing system of judges’ salaries are not assessed enough, taking into account current economic situation in the country.

The Board of Justice supports budget request of the Supreme Court, request for budget of departments of Land books, district (city) courts and regional courts is supported partly

In its session on the 25th of November, having reviewed budget request of courts for 2011 and having expressed an opinion about it, the Council of Justice supported budget request of departments of Land books, district (city) courts and regional courts, summarised by the Ministry of Justice, except for its part on remuneration of judges.

The Board of Justice will review budget requests of the Ministry of Justice and of the Supreme Court for next year

On Tuesday, the 23rd of November, meeting of the Board of Justice took place, in which the Council decided upon replacement of several judges of regional courts and upon determination of concrete regional and district courts, where judges appointed and approved by the Saeima, will execute their duties.

Representatives of judges are elected in the Board of Justice

On September 3, on annual Judicial conference judges elected representatives of judges in the Board of Justice. This decision is important for the history of courts of Latvia, as the Board of Justice has been founded for the first time. Judicial conference elected six representatives, according to representation of court instances that is established in the law “On Judicial Power”: from regional courts – the Chair of Riga regional court Sandra Strence and the Chair of Latgales regional court Andris Strauts, from district courts – the Chair of Administrative district court Ilze Freimane, the judge of the court of Tukuma district Adrija Kasakovska and the judge of the court of Bauskas district Aigars Sniedzitis, from Departments of Land books – the judge of the Department of Land book of Jurmala city Inara Jaunzeme. One more representative of the court – the senator Inara Garda was elected in the Plenary Session of the Supreme Court on August, 30.

On August 30, the Plenary Session of the Supreme Court in secret ballot elected the senator Inara Garda as the representative of the Supreme Court in the Board of Justice.

The Disciplinary Court, representative of the Board of Justice and Chairs of the department and the chamber will be elected in the Plenum of the Supreme Court

On Monday, August 30, the Plenum of judges of the Supreme Court has been summoned. In general session of judges it is necessary to elect representatives of institutions of judicial self-government and heads of structural units. In the Plenum it is necessary to elect one representative of the Supreme Court for a new institution of the court system – the Board of Justice, creation of which has been established by amendments in the law “On Judicial Power”, adopted on June 3, 2010. Chief Justice of the Supreme Court presides over the Board of Justice. Constant members of the Board of Justice are the Chair of the Constitutional court, the Minister of Justice, the Chair of Juridical Committee of Saeima, General prosecutor, the Chairs of the Board of Sworn Advocates, the Board of Sworn Notaries and of the Board of Sworn Bailiffs. Also in composition of the Board of Justice there are one judge elected by the Plenum of the Supreme Court and six judges elected by the Judicial Conference.

The Board of Justice will decide about prolongation of term of office and replacement of judges of the Supreme Court; opinion of the Board will be requested also upon other questions

Further, the total number of judges of the Supreme Court will be established by Saeima, according to a suggestion of the Board of Justice. In its turn, the Board of Justice will decide on number of judges working in the Senate and Chambers, upon the suggestion of the Chief Justice of the Supreme Court. Such procedure has been established by amendments in the Law “On Judicial Power”, which were accepted on June 3, and today have come into force.

Amendments in law, establishing creation of the Board of Justice, have come into force

In Latvia there has been created a new institution of judicial system – the Board of Justice. Today amendments in the law “On Judicial Power”, accepted by Saeima on June 3, came into force, and they establish creation of such collegiate institution that takes part in work out of policy and strategy of judicial system, and also in improvement of organization of work of judicial system. The Chief Justice of the Supreme Court will be also the Chair of the Board of Justice. The Chair of the Constitutional court, the Minister of Justice, the Chair of Juridical Committee of Saeima, General prosecutor, the Chair of the Board of Sworn Advocates, the Chair of the Board of Sworn Notaries and the Chair of the Board of Sworn Bailiffs will be constant members of the Board of Justice. Among members of the Board of Justice there is a judge elected by the Plenum of the Supreme Court and six judges, elected by the Conference of Judges.
