Review of industrial disputes in courts of general jurisdiction is supported

Having discussed recommendations developed by the Ministry of Justice on legal regulation regarding review of industrial property disputes, the Board of Justice considered proposal to review disputes on this property and appealed decisions of the Board of Appeal of the Patent Office under particular procedure in a court of general jurisdiction as that to be supported.

Particular procedure of review of small claims in appellate instance is supported

On April 1, amendments to Section 25027 of the Civil Procedure Law will become effective, and in accordance with those previous procedure of appeal in cases on small claims shall be changed, replacing appeal under cassation procedure by appeal under appellate procedure.

Strengthening of responsibilities of participants of a case for indecent use of rights in civil procedure is supported

The Ministry of Justice, having analysed experience of other countries and performed discussions with experts, developed recommendations on amendments to legal regulations directed to fixing of responsibility to tell the truth to the court in the Civil Procedure Law, and asked for opinion of the Board of Justice, if responsibility of participants of a case for indecent use of rights in civil procedure should be fixed with civil procedural sanctions only, or criminal procedure should be envisaged additionally.

In the sitting of January 27, the Board of Justice unanimously supported candidacy of Gunars Kusins, the Head of the Legal Bureau of the Saeima (Parliament), nominated to the office of a judge of the Constitutional Court.

Court is determined, where the judge appointed by the Saeima will discharge his duties

In the sitting of January 27, the Board of Justice stated that Erlens Ernstsons, who was appointed in the office of a judge of a district (city) court upon decision of the Saeima (the Parliament) of 9 January 2014, will discharge judicial duties in Riga city Zemgale suburb court.

Establishment of joint forensic expertise bureau subordinated to the Ministry of Justice is supported

Having got acquainted with information report prepared by the Ministry of Justice on development of joint forensic expertise centre, which was prepared upon order of the Cabinet of Ministers, the Board of Justice considered it necessary to establish joint forensic expertise centre in the country, which would be subordinated to the Ministry of Justice.

Changes for transition to “clear” court instances in review of civil cases are supported

According to amendments to the law “On Judicial Power” adopted by the Saeima (the Parliament), the Chamber of Civil Cases of the Supreme Court shall be liquidated before the end of 2016, thus terminating transition to so called courts of “clear” instances.

Opinion about candidate to the office of the judge of the Constitutional Court will be provided and fixing of course of a court hearing in audio record will be discussed

On Monday, January 27, the Board of Justice will provide opinion about Gunars Kusins, the candidate to the office of the judge of the Constitutional Court. The candidate to the office of the judge of the Constitutional Court was nominated by 12 deputies of the Saeima (the Parliament).

The Board of Justice supports review of decisions of shareholders’ meetings in one court, but doesn’t agree with appeal of cases in cassation

The Board of Justice, having reviewed law “Amendments to the Civil Procedure Law”, pursuant to request of the Legal Affairs Committee of the Saeima, which were given by the President of the State for repeated revision, supported regulation provided in the law to establish one concrete court to review cases on invalidation of decisions of meetings of participants (shareholders) of capital companies.
