RESTRICTED SERVICES OF INTERPRETERS FREE OF CHARGE IN CIVIL PROCEEDINGS

On 31 July, the amendments to the Civil Procedure Law that reduces the obligation of the state to ensure mandatory free assistance of an interpreter in the court to all natural persons involved in civil proceedings entered into force. The state will provide an interpreter only to those natural persons, who receive state’s provided legal aid or are exempted from legal costs.

PUBLISHED THE TWENTIETH COLLECTION OF THE RULINGS OF THE SUPREME COURT

This week the legal bookshops will start selling of the Collection of Rulings of the Supreme Court of 2015. In the introduction to the book, Ivars Bickovics, the Chief Justice of the Supreme Court, indicates that each judgement and decision of the Supreme Court has been not only resolution of particular dispute, but also answers to questions of fundamental importance for the entire legal system, when establishing and developing case-law. Despite the wide availability of the rulings on the internet, the Supreme Court preserves the tradition to publish annual collection of the rulings in printed format.

SUMMARIZED CASE-LAW ON INSURANCE AGAINST CIVIL LIABILITY IN RESPECT OF THE USE OF MOTOR VEHICLES

Summarized case-law on insurance against civil liability in respect of the use of motor vehicles covers research in Latvian case-law regarding these issues. This is the first compilation where cases of insurance against civil liability in respect of the use of motor vehicles have been analyzed separately from other types of insurance cases. In this compilation are analyzed cases adjudicated by the Department of Civil Cases of the Supreme Court of Latvia in which the Law on Compulsory Civil Liability Insurance of Owners of Motor Vehicles has been applied. In the context of the rulings of the Department of Civil Cases, in some cases the respective rulings of appellate instance court are analyzed. The compilation upon ordered of the Supreme Court was prepared by Dr.iur. Vadims Mantrovs in cooperation with the Division of Case-Law and Research, and the Department of Civil Cases of the Supreme Court.

THE FIRST MEETING OF THE WORKING PARTY OF THE INTERNATIONAL PROJECT IS HELD IN THE SUPREME COURT

The Supreme Court has an important role in the development of national judicial system. It should set an example - both by adopting fair, high quality and valuable legal rulings, as well as ensuring effective, development oriented judicial organization – on July 12, during the opening the European Commission funded project “Supreme Courts as guarantee for effectiveness of judicial systems in European Union” said Sandra Liepina, Head of the Administration of the Supreme Court of Latvia.

The Division of Case-law and Research daily works not only on case-law of the Supreme Court, but also follows the judicial rulings of other countries and international courts. As a result, the first review of rulings is prepared. In this review can be found a brief summary of the most interesting rulings from the first half of 2016 or other topical issues.

The Supreme Court of Latvia is managing the project “Supreme Courts as guarantee for effectiveness of judicial systems in European Union” since June 2016. The project is funded by the European Commission's Directorate-General for Justice and Consumers.

On Friday, 1 July, representatives of the Supreme Court during a meeting with Sir Francis Jacobs, the professor at King’s College London, the former Advocate General at the European Court of Justice, the Queen’s advisor, discussed not only the questions interested by the Latvian judges related to the European Court of Justice, but also the topical issues after the United Kingdom's European Union referendum and the consequences of its withdrawal from the European Union.

SUMMARISED CASE-LAW OF THE DEPARTMENT OF CIVIL CASES ON REOPENING OF A CASE IF THERE IS NEW OR NEWLY DISCOVERED EVIDENCE

The Division of Case-law and Research of the Supreme Court has prepared a compilation of the case-law of the Department of Civil Cases of the Supreme Court on reopening of a case-file where after the ruling became final a request for reexamination of the case on ground of newly discovered circumstances has been submitted.
