RECOMMENDATIONS ON CORRECT STRUCTURING AND DEVELOPMENT OF CONTENT OF COURT RULINGS IN CRIMINAL CASES ARE MADE

Court rulings must be not only legally correct, clear and neat, but their content must be easy to perceive and comprehensible – such conclusions are made in summary prepared by Doctor of Law Elita Nimande, the associate professor at the Department of Criminal Law of the University of Latvia, in cooperation with the Division of Case-law of the Supreme Court.

THE SUPREME COURT APPRECIATES IMPORTANCE OF REGIONAL COURTS IN LATVIAN COURT SYSTEM

When greeting regional courts on the 20th anniversary of their establishment, the Supreme Court points out important place of regional courts in court system both 20 years ago, when, establishing three-level court system in Latvia, appellate instance was restored and regional courts were established after the break lasting for 55 years, and now, when reform of Latvian court system is implemented and, having liquidated Chambers of the Supreme Court, regional courts will remain the only appellate instance. On 27 March, when addressing participants of the ceremonial sitting dedicated to anniversary of regional courts, Ivars Bickovics, the Chief Justice of the Supreme Court, pointed out the fact that not only work load of regional courts, but also their responsibility in respect of development of uniform case-law will increase.

THE SAEIMA DISMISSES ERVINS KUSKIS FROM THE OFFICE OF A JUDGE

In the sitting of 12 March, the Saeima (Parliament) dismissed Ervins Kuskis from the office of a judge of the Supreme Court of his own free will.

COMPILATION OF CASE-LAW IN CRIMINAL CASES ON OFFENCES COMMITTED BY STATE OFFICIALS IS PUBLISHED

Compilation of case-law in cases on application of Sections 317, 318 and 319 of the Criminal Law is discussed and approved for publishing at the general meeting of judges of the Department of Civil Cases of the Supreme Court. Compilation is prepared by Valentija Liholaja, the professor of law at the Department of Criminal Law of the Faculty of Law of the University of Latvia, in cooperation with the Division of Case-law of the Supreme Court.

THE COUNCIL FOR THE JUDICIARY SUPPORTS PROPOSALS OF THE SUPREME COURT: NUMBER OF JUDGES IN DEPARTMENTS IS RE-DISTRIBUTED AND DECISION ON AUTHORITY OF THE DISCIPLINARY COURT WILL BE ADOPTED REPEATEDLY

In the sitting of 9 March, having heard information regarding decisions of the Plenary Session of the Supreme Court by Ivars Bickovics, the Chief Justice of the Supreme Court, the Council for the Judiciary decided to support them, namely, to re-distribute judges’ offices among departments of the Supreme Court, and to re-examine issue regarding expansion of authority of the Disciplinary Court.

On 9 March, during visit to Latvia, internationally recognised expert in civil law, the professor of University of Geneva Benedict Winiger met Edite Vernusa, Valerijans Jonikans and Aigars Strupiss – judges of the Department of Civil Cases of the Supreme Court.

THE SUPREME COURT DOES NOT AGREE TO EXPANSION OF THE AUTHORITY OF THE DISCIPLINARY COURT

The Plenary Session of the Supreme Court of 6 March decided not to support extension of authority of the Disciplinary Court, which envisages that the Disciplinary Court would be appellate instance not only in disciplinary cases of judges, but also those of prosecutors, sworn advocates, notaries and bailiffs, and to review decisions on judges’ careers adopted by the Council for the Judiciary.

CANDIDATES TO THE OFFICE OF THE CHIEF JUSTICE OF THE SUPREME COURT MUST BE NOMINATED UNTIL 7 APRIL

In June, term of office of Ivars Bickovics, the Chief Justice of the Supreme Court, expires. Judges of the Supreme Court must nominate candidates to the office of the Chief Justice of the Supreme Court from among their peers.

DZALBE IS ELECTED TO THE OFFICE OF A MEMBER OF THE CENTRAL ELECTION COMMITTEE, AND GARDA IS ELECTED TO THE OFFICE OF THE SECRETARY OF THE PLENARY SESSION

The Plenary Session of the Supreme Court re-elected Peteris Dzalbe, the Chair of the Department of Criminal Cases, to the office of a representative of judges to the Central Election Committee. Being elected repeatedly, Peteris Dzalbe has discharged these duties since 2009.
