Summarized case-law on insurance against civil liability in respect of the use of motor vehicles covers research in Latvian case-law regarding these issues. This is the first compilation where cases of insurance against civil liability in respect of the use of motor vehicles have been analyzed separately from other types of insurance cases. In this compilation are analyzed cases adjudicated by the Department of Civil Cases of the Supreme Court of Latvia in which the Law on Compulsory Civil Liability Insurance of Owners of Motor Vehicles has been applied. In the context of the rulings of the Department of Civil Cases, in some cases the respective rulings of appellate instance court are analyzed. The compilation upon ordered of the Supreme Court was prepared by Dr.iur. Vadims Mantrovs in cooperation with the Division of Case-Law and Research, and the Department of Civil Cases of the Supreme Court.

This research of case-law covers the essential issues of insurance against civil liability in respect of the use of motor vehicles that have been addressed in case-law of Latvian courts, starting with the questions about the agreement of insurance against civil liability in respect of the use of motor vehicles and continuing with the payment of compensation, questions about liability and evaluation of evidence that justify civil liability of the driver of the vehicle; the reasons for the refusal of the insurance reimbursement and subrogation action. At the same time it must be stressed that this compilation covers only those issues which have been analyzed in the cases before the Department of Civil Cases.

The compilation of case-law indicates the main conclusions which may be used by the courts when adjudicating cases of insurance against civil liability in respect of the use of motor vehicles.
