Extensive summary of conclusions of case-law of administrative courts in cases on social security or social guarantees is published on the web site of the Supreme Court, in section “Judicature”. Compilation was prepared by Mg.iur. Anita Kovalevska, the judge of the Administrative regional court, in cooperation with the Department of Administrative Cases and the Division of Case-law of the Supreme Court.

To prepare compilation of court decisions, the Division of Case-law selected approximately 400 rulings by the Administrative regional court and the Department of Administrative Cases of the Senate passed in 2007-2013. Rulings by the Administrative regional court were selected only if they had become effective.  To prepare compilation, rulings related to classical elements of social security system, namely, state social insurance, social aid and state support provided as state social benefits, were selected.  

The compilation does not include conclusions on long-service pensions and other social guarantees related to holding of particular offices, medical treatment services, payment of provisions from the Maintenance Guarantee Fund, and payments from fund of guarantee of employees’ claims. The compilation also does not include conclusions on such specific issues related to social security issues, as benefit to refugee and person, who was granted alternative status, or benefits to orphans and children left without parental care, who have reached age of 18 years.

Compilation of court decisions is formed as summary of quoted conclusions of court rulings, and these conclusions are arranged in thematic blocks. For convenience of users of the compilation, there is highlighted thesis at the beginning of each quote. The thesis is concluded from respective quote, but reference to particular clause of quoted ruling is given at the end. Although legal provisions analysed in several rulings are amended, conclusions by courts on these provisions, however, are included in the compilation, if they can be used in other cases. For example, legal provisions on calculation of child’s care benefit are amended, but conclusions on legal equity expressed in cases on child’s care benefit may be used in other cases as well.

Compilation consists of six sections. The first section includes summary of general conclusions on social security system. The second section comprises conclusions on state social insurance, the third section – on social protection of participants to liquidation of consequences of disaster at Chernobyl atomic power plant and persons suffered in result of disaster at Chernobyl atomic power plant, the fourth section – on state social benefits, but the fifth section includes conclusions on social aid.  The sixth section, in turn, comprises conclusions on different procedural issues expressed, when reviewing cases on social security system.
